This property was formerly a gas station and there is an " one open case" with the NYSDEC. Samples will continue to be taken over the next six months. If these samples come back with a positive result, which is likely, the seller will ask for a closure letter from DEC at that time. If these samples show that additional monitoring/remediation is needed, the seller would list the open case as a "retained liability" in a PSA that the seller would bear all costs in order to go forward until the "DEC closure letter" is received. This open case only applies to a 20' by 20' area, a relatively small portion of the site where the remediation equipment is currently sitting.
